These Terms of Service ("Terms") govern your access to and use of Limbwalkers Academy, operated by Limbwalkers Unlimited LLC ("Company," "we," "us," or "our"). By accessing, browsing, or using the website and application (the "Service") in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

By using the Service, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. 2. Description of Service

Limbwalkers Academy is an educational platform designed to assist users in studying for the International Society of Arboriculture (ISA) Certified Arborist examination. The Service provides study materials, practice questions, AI-powered tutoring, flashcards, and related educational tools.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service or servers/networks connected to it
• Scrape, crawl, or use automated means to access the Service without permission
• Reproduce, distribute, or commercially exploit our content without authorization

All content, materials, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, video, software, code, AI-generated content, lesson materials, quiz questions, flashcards, study guides, and the overall design and arrangement thereof — are the exclusive property of Limbwalkers Unlimited LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes only. This license does not include the right to:

• Modify, copy, or create derivative works based on the Service
• Use any data mining, robots, or similar data gathering tools
• Download (other than page caching) any portion of the Service
• Use the Service or its content for any commercial purpose
• Reproduce or redistribute quiz questions, lesson content, or study materials

The Service uses artificial intelligence to provide tutoring, generate explanations, and personalize your learning experience. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or misleading
• AI responses do not constitute professional arboricultural advice and should not be relied upon as the sole source of information
• Your conversations with the AI tutor may be stored and analyzed to improve the Service
• We are not responsible for any decisions or actions taken based on AI-generated content
• AI features may be modified, limited, or discontinued at any time without notice

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INCLUDING AI-GENERATED CONTENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

You agree to indemnify, defend, and hold harmless Limbwalkers Unlimited LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any claim that your use of the Service caused damage to a third party
• Any application of information obtained through the Service to real-world tree care activities

11. Subscription and Payments

Certain features of the Service may require a paid subscription. All payments are non-refundable unless otherwise required by applicable law. We reserve the right to change pricing at any time with reasonable notice. Failure to pay may result in suspension or termination of your access to premium features.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and disclaimer provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Georgia, United States. You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Georgia.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Limbwalkers Unlimited LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
